1. Enemy Combatants are those beings aiding, working for, or working on behalf of any criminal organization, or organization with which the New Republic is at war. In addition, those beings that attack the New Republic may be treated as Enemy Combatants. 
 
2.1. Enemy Combatants may be dealt with as the relevant Operational Commander finds necessary, barring orders to the contrary. The authorized assault or killing of Enemy Combatants is not punishable under the Criminal Code. 
2.2. The Commander must report actions taken against the enemy, as well as captured and killed enemy combatants, to the High Command. Improper actions may be tried at court martial. 
2.3. The High Command determines whether an officer qualifies as an Operational Commander at their time of action. 
 
3.1. The DNRI or DDNRI may authorize NRI Agents to take action against Enemy Combatants as the Agent finds necessary, barring orders to the contrary. The authorized assault or killing of Enemy Combatants is not punishable under the Criminal Code. 
3.2. The NRI agent must report actions taken against the enemy, as well as captured and killed Enemy Combatants, to the DNRI or DDNRI. Improper actions may be tried at a criminal court. 
 
4.1. The Judicial Procedure Act and the Sentencing Guidelines of the Criminal Code do not apply to Enemy Personnel, however military authorities may hold a tribunal. 
4.2. Those tribunals consist of no less than three flag officers. 
4.3. The goal of the tribunal is to hear of an Enemy Combatant's Crimes against Sentience, which include assisting or conspiring in mass or indiscriminate killings. 
4.4. Upon a unanimous guilty verdict, the enemy will be sentenced by the tribunal. The tribunal may sentence the enemy combatant to imprisonment for life or execution, or may order the enemy combatant to be held at the discretion of the Chief of Military Operations. 
4.5. Upon any other verdict, the Enemy Combatant will be held at the discretion of the Chief of Military Operations. 
4.6. Should no tribunal be held, the Enemy Combatant will be held at the discretion of the Chief of Military Operations.
